Indian Judiciary System - An old one
This blog from me comes in the heels of the judgements passed by our courts in some high profile cases, the Bombay blast case and Daboo case and many other high profiles one too.
People are happy (generally) with the verdict. But at what cost has this come about. The bombay blast case verdict has taken 13 yrs in coming and the Daboo case about 8 yrs. And another point of note is that these have been passed only in the lower courts, so many convicted persons have the chance to appeal again in higher courts. The general consensus is that if you are convicted in lower courts appeal in higher courts, the case shall come up only after another 10 yrs or so, if it isnt that important, so you can scout free until that time. This has lead to a backlog of about 27,000 cases (at around 2004) in the Supreme court. I dont have an idea about the backlog scenario presently.
So, I would like to ask is in general the Indian Judicial System creaking slowly. The system is an old one. Does it need to be replaced or atleast modified. Will the people have the courage to change the system?
